Payment of Wages Act, 1936 Supreme court judgement delivered in the civil appeal no 147 of 1983of A.V Cesta versus B.C Patel that the Authority under the P.W Act has no jurisdiction to determine potential wages. (i) Railway Administrations advised by the Board that in future cases where the employees were orders of the Superior officer was necessary the Authority power under section 15 of the Act could not be challanged (ii) that in cases where the specific order of the superior authority was necessary in the matter of pay, the power to issue any direction under section 15 of the Act by the Authority should be challenged on the lines indicated in the judgement of the supreme court and (iii)That so far as past cases were concerned the judgement could ot be automatically applied as ab appeal on the lines of the supreme court judgement had to be filled if according to procedure it was possible to do so
