Rules & Regulation. Recommendation of the Railway Corruption Enquiry Committee, 1953, regarding the simplification of Enquiry Procedure, in cases of departmental action against railway servants. Instructions were issued to the Railway on the following points clarifying the scope of Art.311 (2) of the Constitution & also Disciplinary Rules. a) departmental enquiry need not be carried out strictly in accordance with the rules applicable to judicial proceedings butthe principles of natural justice should be followed. b) no employee should be condomned on ex. Parte evidence in a departmental enquiry. The opportunity, which the Law requires should be given to him, so that he can avail of that opportunity effectively in refuting the charges and statements on which the notice of such dismissal of removal is based. c) The second notice against the punishment proposed should be issued to enable him to show cause. d) Except in complicated cases of corruption enquiry might be conducted by a single officer
