Interpretation of the term recognised Railway Trade Union appearing in Rules 1707 (c) and 1721 A.R.I.- Question whether the person accompanying the accused in terms of these rules should be an official of any Trade Union or an official of a Trade Union recognised by the Railway. The Intention of rules 1707 (c) and 1721-ARI is that (1) the Railway servant accompanying the accused in a departmental enquiry or personal hearing should be an employee of the same Railway in which the accused is employed; and (ii) in case the accused is accompanied by a Trade Union official, the Trade Union Should have been recognised by the same Railway in which the accused is employed. The above rules amended to clarify the intension. Decision that the personal hearing by the Appellate authority contemplated in rule 1721-AR.I is obligatory only when the appellant asks for it; In other cases it is discretionary for the appellate authority
