The following matters about the application of Article 311 (2) of the Constitution and the disciplinary rules were clarified in instructions given to the Railway. a) Departmental investigations need not be conducted in strict conformity with the procedures that apply to judicial proceedings, but they should nonetheless adhere to the principles of natural justice. b) No employee should be excused based on ex-parte testimony in a departmental inquiry.
