Question whether leave under F.R. 86 can be granted to Judges of High Courts after the date of their Compulsory retirement. Decided that (1) Judges of High Courts, whether I.C.S. or non I.C.S., cannot be allowed the benefit of F.R. 86 (a), ie. the refund refused leave cannot be granted after they attain the age of 60 years; (2) no extension of services to those Judges of High Courts in Part (A) states, who were appointed before 1st April 1937, can be granted after the commencement of the New Constitution
