Reference from the Southern Railway whether a second enquiry need be held in cases of Accidents after receiving the reply to the charge-sheet in almost all cases. Instructions issued to Indian Railways that in cases where disciplinary action has been initiated as a result of the findings of the accident enquiry, a further enquiry, after the issue of a charge sheet will be necessary if the penalty imposed is either dismissal, removal or reduction in rank. The Board further examined this question and came to the conclusion vide their letter No.55TTV5/6 dated 1.7.57 that the procedure has been revised in conformity with the provisions of article 311(2) of the Constitution and that, therefore, it is necessary to hold a second enquiry in certain cases depending upon the nature of the disciplinary action to be taken as directed in Board's letter No.E(D & A)57RG6-6 of 26.4.57
