I am directed to acknowledge the receipt of your letter, No. 600-135, of the 12th October 1864 and in reply to state that as an Uncovenanted Officer who obtains leave on private affairs under Section 12 of the Leave Rules of the 13th April 1864, is allowed to draw his absentee pay monthly, during such absence, the more circumstance of his resigning his appointment without return to duty would not render him liable to a refund of that absentee pay.
