The decision is that (1) instances involving officers covered by F.R. 56(b)(i) who were either retired or forced to proceed on L.P.R. upon turning 55 but before turning 60 years old, are not obliged to be reopened, either on their own initiative or at the request of the parties involved. (ii) Employees of the government-taken over ex-GIP Rly Co are not eligible to receive benefits under Rules 2046(2)(a) R-II [F.R.56(b) (i)]. (iii) Individuals whose cases were processed on or after August 9, 1948 (and not on October 19, 1948) must have their cases examined; those whose cases were processed on or before August 9, 1948, will not be reviewed
