When disciplinary action is being considered for an offence committed by Class III personnel working in Class I or II service, it is important to take into account the authority that has the jurisdiction to inflict the penalty of dismissal or removal.- Decision that when an employee is requested to be terminated and is a Class III employee, it is the appointing authority of Class III officer who is competent to award the penalty. The rule stated in clause (1) of Article 311 of the constitution refers to the penalty and not the offence. It doesn't matter that he was serving in a higher position when the crime was committed
