A question whether compensation is payable to railway employees whose monthly wages exceeds Rs. 500/- p.m. Decision: In accordance with deification of 'Workman' defined in section 2(1) (n) of the W.C.Act, employment on Monthly wages not exceeding Rs.500/- is not relevant where a person suffering an accident arising out of and in the course of his employment is a railway servant as is defined in section 3 of the Indian Railway Act, 1890 and is not permanently employed in any administrative district or sub-divisional office of a railway and is not also employed in any such capacity as is specified in schedule II. In other words, in the case of such a railway servant, compensation under the Act is awardable inspite of the monthly wages exceeding Rs.500/-
