The power to determine the criteria for the purposes of (a) the Provincial excise Acts is vested in the province; (b) the Sea Customs Act is vested in the Federation; and (c) Excises, both the Centre and the province can prescribe according as the liquor is fit for human consumption or hot. In case of conflict, the criteria would be open to challenge in the Federal Court.
