Decision that Governors acting on the advice of their Ministers are competent to make rules govering the grant of fees for non-professional attendance in respect of Indian Medical Service Officers serving in the Provinces unless the Secretary of State himself makes rules under Section 247(1)(b) of the Government of India Act, 1935 or the Governor General issues directions under Section 54 of the Act, the orders issued by the Governor-General in Council under F.R.46-A being ultra vires of the Act.
