Question whether the Governor-general possesses the ``prerogative of mercy`` as apart form the operation of Section, 401, of the Criminal Procedure Code. Also whether in India the delegation by His Majesty to the Governor-general of the power to grant free or conditional pardons amounts to a delegation of the prerogative of mercy to its full extent.
